Welcome to MellowMeta. By accessing mellowmeta.xyz, requesting a quote, purchasing services, or entering into a service agreement with MellowMeta LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use this website or its services.

Use of the Site

  • You must be at least 18 years old or have parental consent to use our services.
  • You agree not to misuse, exploit, or interfere with the website or its services in any way.
  • You agree not to use our services for any unlawful purpose.

Services & Pricing

  • MellowMeta LLC provides web design, WordPress development, website hosting, and related digital services.
  • All prices displayed on this website are subject to change at any time without prior notice.
  • Pricing confirmed in a signed Client Service Agreement will be honored for that project.
  • Hosting plan rates may change with 30 days' written notice to active clients. Continued use of hosting services after the effective date of a rate change constitutes acceptance of the new rate.
  • MellowMeta LLC reserves the right to discontinue any service offering at any time.

Web Design & Hosting Requirement

  • All web design services require an active MellowMeta hosting plan. MellowMeta LLC does not transfer site files or deploy websites to client-controlled or third-party servers.
  • Website files, databases, and project assets remain on MellowMeta LLC's managed server at all times.
  • Clients on Wix, Squarespace, or any other site builder cannot migrate their existing site to WordPress — a full new WordPress build is required.

Payment

  • Web design projects require a 50% non-refundable deposit before work begins. The remaining 50% is due upon completion before the site goes live.
  • Hosting fees are billed monthly via Wave and are due upon receipt of invoice.
  • Accounts more than 14 days past due may incur a late fee and services may be suspended until the balance is cleared.
  • Third-party software and plugin costs are passed through at exact cost with no markup and appear as line items on the monthly invoice.

No Guarantee of Results

MellowMeta LLC makes no warranties or guarantees regarding search engine rankings, website traffic, sales, leads, conversions, or any other business outcomes. Services are provided as professional services based on current best practices. Results depend on factors outside MellowMeta LLC's control.

Intellectual Property

  • All content on mellowmeta.xyz — including text, graphics, logos, and design elements — is the property of MellowMeta LLC and may not be copied or distributed without written permission.
  • Custom work delivered to clients becomes the client's property upon receipt of final payment in full.
  • Third-party assets (plugins, themes, fonts, stock images) remain subject to their respective licenses.

Hosting & Uptime

  • No hosting service can guarantee 100% uptime. MellowMeta LLC is not liable for website downtime, service interruptions, or data loss resulting from server maintenance, hosting provider issues, software updates, cyberattacks, or any other cause outside its reasonable control.
  • Weekly backups are maintained to minimize risk but are not guaranteed to be error-free or complete in all circumstances.

Third-Party Services

MellowMeta LLC uses and may recommend third-party services including WordPress, Elementor, A2 Hosting, Google, and Wave. MellowMeta LLC is not responsible for the availability, performance, pricing changes, or terms of any third-party service. Clients are responsible for maintaining their own accounts and licenses with third-party providers after project handoff.

Cancellation

  • Design project deposits are non-refundable once work has begun.
  • Hosting plans may be cancelled with 7 days' written notice before the next billing cycle. No partial month refunds.
  • MellowMeta LLC reserves the right to terminate services for non-payment, abusive conduct, or illegal use without refund.

Limitation of Liability

To the maximum extent permitted by applicable law, MellowMeta LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of this website or services, including but not limited to lost revenue, lost data, or business interruption. MellowMeta LLC's total liability for any claim shall not exceed the total amount paid by the client in the 90 days preceding the claim.

Governing Law

These Terms of Service are governed by the laws of the Commonwealth of Pennsylvania. Any disputes shall be subject to the jurisdiction of the courts of Pennsylvania. Both parties agree to attempt good-faith resolution before initiating legal proceedings.

Changes to These Terms

MellowMeta LLC reserves the right to update these Terms of Service at any time. Updated terms will be posted on this page with a revised date. Continued use of the website or services after changes are posted constitutes acceptance of the revised terms.
